Terms of Use

The terms that apply when you use the Pxie website, API and MCP server.

Last updated

These Terms of Use (“Terms”) are an agreement between you and Pxie (“we”, “us”) covering the Pxie website, the Pxie API, the Pxie MCP server, the dashboard and any related services (together, the “Service”). By creating an account, generating an API key or using the Service you agree to these Terms. If you use the Service for an organization, you confirm you can bind that organization.

1. The Service

Pxie provides environmental and space weather data through a web API and an MCP server: space weather, aurora, ground magnetometer data, power grid geomagnetic risk, ocean, soil and agriculture, sky quality and astronomy data. We may add, change or retire features. Features marked “In testing” or “Coming soon” are not final, may be inaccurate or change without notice, and are provided for evaluation only.

2. Accounts and API keys

3. Plans, credits and payment

4. Acceptable use

You agree not to:

Where a data page or response requires attribution (for example a “Powered by Pxie” notice and any source named in the response headers), you agree to display it as described in our documentation.

5. Data are forecasts and models, not guarantees

Space weather, aurora, soil, sky and ocean outputs are forecasts, estimates or modeled values. Ground sensor networks can be incomplete or delayed, and models can be wrong. In particular:

Do not use the Service as the sole input to a decision where an error could cause injury, loss of life or serious property damage.

6. Third-party data and attribution

Some outputs are built from public or licensed third-party data. We name sources in our documentation and response headers where required. Third-party data remains subject to its owners’ terms.

7. Intellectual property

Pxie owns the Service, its software, computed data products and branding. We grant you a limited, non-exclusive, non-transferable right to access and use the Service and its outputs in your own products and internal work, subject to these Terms. You keep ownership of the data you send us and of your own products.

8. Your data and privacy

Our Privacy Policy explains how we handle personal information. Our Data Processing page describes how we handle customer data and our service providers. Our Security page describes our security practices.

9. Availability and support

We work to keep the Service available, but it is provided without a guarantee of uninterrupted or error-free operation, and we may carry out maintenance. The Scale plan includes a service-level agreement; its terms are provided with that plan. Support is provided as described for your plan.

10. Disclaimers

The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose, accuracy and non-infringement.

11. Limitation of liability

To the fullest extent permitted by law, Pxie is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business, arising from your use of the Service. Pxie’s total liability for any claim relating to the Service is limited to the fees you paid to Pxie in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law.

12. Indemnity

You agree to defend and compensate Pxie against claims arising from your breach of these Terms or from your misuse of the Service, to the extent permitted by law.

13. Suspension and termination

You may stop using the Service and close your account at any time. We may suspend or end access if you breach these Terms, if payment fails, or if needed to protect the Service. Sections that by their nature should continue (including 5, 7, 10, 11, 12 and 15) survive termination.

14. Changes to these Terms

We may update these Terms. We will post the new version here with a new date and, for material changes, notify account holders by email. Continued use after the effective date means you accept the update.

15. Governing law

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there. You agree to the exclusive jurisdiction of the courts of Alberta, except where the law of your location gives you the right to bring a claim elsewhere.
